If you have been arrested it is of utmost importance that you not make the typical mistakes that accused people make. First of all you should know that by the time a police officer has arrested you they have concluded that you are guilty. The law does not allow officers to arrest people without cause. Rather, the arresting officer must generally have a warrant, or “probable cause” to arrest you. Good investigators know that shortly after arrest, suspects are highly likely to be excited, extremely scared, and confused. Quite frequently I see scared, nervous clients who, in a great panic to prove their innocence say things that hurt themselves. LET ME SPEAK FOR YOU! If you are arrested, the number one rule to remember is DEMAND AN ATTORNEY AND SAY NOTHING. Trying to talk your way out it is always a loosing proposition regardless of your innocence. Remember, by the time you are arrested, you are already considered guilty by the police. Whatever you say is going to be treated as an attempt to talk your way out of trouble, not the truth.
If you have a loved one who has been arrested, don’t ask them for an explanation. Calls and conversations to prisoners are recorded and used for prosecution. Don’t hurt your loved one by questioning them on the phone. They are scared and irrational and are highly likely to say things that preclude a defense.
